1. About Us

TSD Production is a digital creative agency providing professional services including but not limited to:

2. Acceptance of Terms

By placing an order, making a payment, or using our website, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

3. Project Quotation

Every project is based on a custom quotation.

The quotation may include:

  • Scope of work
  • Deliverables
  • Timeline
  • Number of revisions
  • Final file formats
  • Total project cost

Any work requested outside the approved quotation shall be treated as additional work and charged separately.

4. Payments

Projects generally require an advance payment before work begins.

The remaining balance must be paid before the delivery of final source files unless otherwise agreed in writing.

Failure to make payments on time may delay the project.

TSD Production reserves the right to suspend or terminate any ongoing project due to non-payment.

5. Project Timeline

Estimated delivery dates are provided for planning purposes only.

Project timelines may change due to:

  • Delay in client feedback
  • Delay in receiving project materials
  • Change in project requirements
  • Force majeure events
  • Technical issues beyond our control

6. Client Responsibilities

The client agrees to:

  • Provide accurate information.
  • Submit required files on time.
  • Review submitted work promptly.
  • Provide clear feedback.
  • Ensure they own or have permission to use all supplied materials.

TSD Production is not responsible for copyright issues arising from client-provided content.

7. Revisions Policy

Each project includes a maximum of three (3) revisions, unless otherwise stated in the quotation.

A revision means minor modifications to the approved concept, such as:

  • Text corrections
  • Color adjustments
  • Minor layout changes
  • Small animation timing changes

The following are not considered revisions:

  • Complete redesign
  • New concept
  • New animation style
  • Major structural changes
  • New branding direction
  • Additional scenes
  • Additional pages

Such requests will be treated as new work and charged separately.

8. Project Approval

Once the client approves the final design, animation, or deliverable, the project will be considered completed.

Any further changes requested after approval may incur additional charges.

9. Source Files

Editable source files (such as AI, PSD, AE, Blender, C4D, Figma, etc.) will only be provided if they are included in the quotation or specifically purchased.

Otherwise, only the agreed final exported files will be delivered.

10. Ownership & Copyright

All intellectual property rights remain with TSD Production until full payment has been received.

After full payment, the client receives ownership of the final approved deliverables unless otherwise agreed.

TSD Production retains the right to display completed projects in its portfolio, website, social media, advertisements, and promotional materials unless a written confidentiality agreement states otherwise.

11. Third-Party Assets

Projects may include licensed fonts, stock images, stock videos, plugins, templates, or music.

Such assets remain subject to their respective licenses.

The client is responsible for purchasing any additional commercial licenses if required.

12. Project Cancellation

If the client decides to cancel a project after work has started:

  • Payments already made are non-refundable.
  • Work completed up to the cancellation date will be billed accordingly.
  • Any remaining unpaid work must be settled before project closure.

13. No Guarantee

While we strive to deliver high-quality creative work, we do not guarantee:

  • Specific business results
  • Sales increase
  • Social media growth
  • Search engine rankings
  • YouTube monetization
  • Advertisement performance

Creative services are subjective and outcomes depend on multiple external factors.

14. Acceptable Use

You agree not to use our services for:

  • Illegal activities
  • Fraudulent purposes
  • Hate speech
  • Adult content
  • Copyright infringement
  • Trademark violations
  • Defamatory material
  • Malware or harmful software

TSD Production reserves the right to refuse any project that violates applicable laws or ethical standards.

15. Confidentiality

Any confidential information shared during the project will be treated with reasonable care and will not be disclosed to third parties without permission, except where required by law.

16. Limitation of Liability

TSD Production shall not be liable for:

  • Indirect damages
  • Loss of business
  • Loss of profits
  • Loss of data
  • Delays caused by third parties
  • Website downtime
  • Platform failures

Our maximum liability shall never exceed the amount actually paid by the client for the specific project.

17. Force Majeure

We shall not be held responsible for delays or failures caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Internet outages
  • Government restrictions
  • Power failures
  • War
  • Pandemic
  • Server failures

18. Changes to Terms

We reserve the right to update these Terms & Conditions at any time without prior notice.

The latest version published on our website shall always apply.

19. Governing Law

These Terms shall be governed by the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Aligarh, Uttar Pradesh, India.
